1. Booking and confirmation
There is no minimum contract, spend, number of contractors, shifts or hours. Each assignment is separate. Requests go through the Agency; availability is not guaranteed, contractors may accept or decline, and a booking is confirmed only when the Agency records or communicates confirmation.
2. Assignment details and changes
Provide accurate venue, role, location, dates, hours, expenses, experience, qualification and safety requirements. Contractors work within the agreed Service Category and Service Scope. New shifts, future availability, material changes to hours, duties, location or rates, and cancellations must go through the Agency. A materially different role requires an Agency amendment and the contractor's agreement where required.
3. Communication and working practices
Normal service communication about tables, customers, menus, allergens, equipment and venue requirements is allowed. For assignments expressly designated Independent Contractor / No-SDC, the Client must not assume a general right to control how ordinary professional services are performed or impose employee-style management. Safety and legal intervention remain permitted. Actual working practices matter; contractual wording alone does not determine legal or tax status.
4. Safety, suitability and concerns
The Client is responsible for a safe venue, disclosing known risks and providing necessary site information, equipment or training. Tell the Agency about required qualifications and authorisations. Report incidents, formal complaints, replacement requests and material changes promptly. The Agency takes applicable onboarding and suitability steps and may investigate concerns. Immediate practical issues may be raised directly; urgent safety action must not wait.
5. Hours, charges and payment
Record actual start and finish times accurately and report discrepancies promptly. Unless otherwise agreed, charges use actual agreed hours at the Agency's confirmed rate. VAT is added where legally chargeable. Pay invoices by the agreed due date; raise specific disputes promptly and pay undisputed amounts on time. Contractors are paid by the Agency unless expressly agreed otherwise. Refer rate changes, bonuses and expenses to the Agency.
6. Tips and service charges
The Client determines participation and each contractor's final monetary allocation under its tipping policy and applicable law. Tips are not guaranteed and do not replace the agreed assignment rate. The Agency passes on 100% of allocated tips actually received, without Agency margin or commission, subject only to legally required deductions or withholding. Applicable statutory tipping duties remain in force.
7. Cancellations
Give the Agency as much notice as reasonably possible. A cancellation or call-out charge following travel, arrival or commencement of work applies only where expressly agreed or otherwise lawful. Informing only the contractor does not replace notifying the Agency.
8. Direct engagement
Notify the Agency in writing before finalising direct engagement or engagement through another business. A £300 transfer fee applies only where lawfully enforceable under Regulation 10 and the full Terms. Alternatively, choose an 8-week Extended Hire Period, on terms no less favourable than immediately before notification, then engage the contractor directly without that transfer fee. Statutory time limits take priority; notification does not restart them. The Agency does not impose a fee outside the circumstances permitted by law.
9. Records, privacy and reviews
Keep non-public business information confidential and use contractor data only for lawful purposes. Make these rules available to relevant managers, answer working-practice reviews truthfully and report differences between the agreed model and actual practice. The Agency may retain assignment and compliance records. Applicable equality, recruitment, data-protection and individual statutory rights remain protected.
10. Ending supply and governing terms
Either party may stop future assignments, subject to a separate written commitment. Existing payment and other accrued obligations remain. The Agency may suspend supply for payment, safety, compliance or other serious concerns. Each party remains responsible for its own breach, negligence or unlawful conduct; liability that cannot legally be excluded remains. The full Terms address circumstances outside reasonable control, notices and changes. England and Wales law and courts apply, subject to mandatory law.
